1.1 Who we are

1.2 Our Services
We provide a platform through our website (www.ahead.clinic) and our Ahead App that allows you to book health screening services, receive scan results, and access health insights. We facilitate connections between you and our medical partners, but we do not provide medical treatment ourselves. Our medical partners are carefully selected to ensure they align with our values of customer-centricity and medical quality.
1.3 Acceptance of Terms
By accessing our website, using our services, creating an account, or booking appointments, you agree to these Terms and Conditions. If you do not agree with these terms, please do not use our services. The Terms and Conditions together with our Privacy Policy constitute the entire agreement between you and Ahead Health AG regarding your use of our services.
You acknowledge that these Terms and Conditions constitute a valid and binding agreement electronically entered into, with the same force and effect as agreements physically signed by you.
1.4 Relationship to Privacy Policy
Our Privacy Policy, available on our website, explains how we collect, use, and protect your personal data. The Privacy Policy forms an integral part of these Terms and Conditions.
2. User Eligibility and Account
2.1 Age Requirements
Our services are intended for individuals who are at least 18 years old and capable of entering into a legally binding agreement. If you are under 18, you may only use our services with the written consent of your legal guardian.
2.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to immediately notify us of any unauthorized use of your account. We reserve the right to suspend or terminate your account if we suspect misuse.
2.3 Accuracy of Information
You must provide accurate, complete, and current information when creating an account and booking services. You agree to update your information promptly if it changes.
3. Our Services
3.1 Booking Services
We facilitate the booking of health screening appointments with our medical partners. By confirming a booking, you authorize us to make arrangements on your behalf with the relevant medical partner.
3.2 Medical Disclaimer
Information provided on our website and app is for general information purposes only and does not constitute medical advice. Always consult with qualified healthcare professionals regarding your specific health concerns.
3.3 Role as Intermediary
We act solely as an intermediary between you and our medical partners. The medical services are provided by third-party healthcare professionals, and we are not responsible for the medical care you receive. However, we carefully select our partners to ensure they align with our values of customer-centricity and medical quality.
The relationship between Ahead and its medical partners is that of independent contractors. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship.
3.4 Reporting App
Our reporting app allows you to access your scan results and health insights. Use of the app is subject to these Terms and Conditions.
4. Appointments and Cancellations
4.1 Booking Confirmation
After booking an appointment through our platform, you will receive a confirmation via email or through our app. The appointment is only confirmed after you receive this confirmation.
4.2 Cancellations and Rescheduling
You may cancel or reschedule your appointment up to 48hours before the scheduled time by contacting us at get@ahead.clinic. For cancellations less than 48 hours before your appointment, or if you fail to attend a confirmed appointment, your claim to the service booked for that appointment expires without any right to compensation or refund. A cancellation fee may be charged as specified as deposit during the booking process.
4.3 Medical Partner Cancellations
Our medical partners may need to cancel or reschedule appointments due to unforeseen circumstances. We will notify you promptly and help you reschedule, but we are not liable for any inconvenience or costs resulting from such cancellations.
4.4 Late Arrival
If you arrive late for an appointment, your entitlement to services generally exists only for the remaining scheduled time. If your late arrival makes the scheduled consultation or treatment no longer feasible, your claim to the service booked for that appointment expires without any right to compensation or refund.
5. Fees and Payment
5.1 Service Fees
The fees for our services are clearly displayed during the booking process. These may include booking fees, service fees, and the cost of the medical service itself. All prices include VAT where applicable.
5.2 Payment Terms
Unless otherwise specified, payment terms are as follows:
A deposit of 10% of the total treatment costs may be required at the time of booking
The remaining balance is due no later than 30 days after completion of treatment
5.3 Payment Options
We may offer installment payment options under certain conditions. For information about payment options, please contact us via email get@ahead.clinic.
5.4 Non-Payment
In case of complete or partial non-payment, we reserve the right not to provide and to suspend our services.
5.5 Transaction Costs
You agree to fully bear any fees or other transaction costs that may be incurred during the transfer.
5.6 Currency
Payments must be made in Swiss Francs (CHF), unless we offer payment in another currency.
5.7 Price Changes
We reserve the right to change our prices at any time, but changes will not affect bookings that have already been confirmed.
5.8 Refunds
Refund policies vary depending on the specific service and cancellation circumstances. These will be communicated during the booking process.
6. User Obligations
6.1 Responsible Use
You agree to:
Act in good faith and provide truthful information about your person, health, and physical condition
Notify us promptly of any changes to your information, health, or physical condition
Provide us with your correct contact information
Be able to pay for services at the time of booking
Promptly notify us of any payment inability that arises during treatment
Follow the instructions of our staff when using our services
Only transmit to us information and documents that you are entitled to and that may be shared with us
Read carefully the patient information and other information about the services made available to you before using them
Honor your appointments or cancel them in accordance with our cancellation policy
6.2 Prohibited Activities
You may not:
Use our services for illegal, fraudulent, or harmful purposes
Interfere with the proper functioning of our website or app
Attempt to access restricted areas of our systems
Share your account credentials with others
Violate the rights of others, including their privacy and intellectual property rights
7. Intellectual Property
7.1 Our Intellectual Property
All content on our website and app, including but not limited to text, graphics, logos, images, software, and design, is owned by or licensed to Ahead Health AG and is protected by copyright and other intellectual property laws.
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use our website and app for personal, non-commercial purposes in accordance with these Terms and Conditions.
7.3 Restrictions
You may not reproduce, modify, distribute, display, perform, or create derivative works from any content on our website or app without our prior written consent.
8. Risks and Side Effects
8.1 Information Disclosure
The patient information provides information about how the analyses and treatments are performed and what risks and side effects may occur. It also provides information about non-medical services. Please read the patient information carefully and ask us any questions you may have.
8.2 Acknowledgment of Understanding
By accepting these Terms and Conditions, you declare that you have read and fully understood the patient information.
9. Limitation of Liability
9.1 Assumption of Risk
You assure us that you have familiarized yourself with the risks and side effects of the services (including activities) and that you use the services (including activities) voluntarily and at your own risk.
9.2 Exclusion of Liability
To the extent permitted by law, you declare (including your heirs, representatives, and agents):
(a) To fully indemnify and hold harmless us, our representatives, agents, employees, other customers and other participants in activities, sponsors, advertisers and, if applicable, owners and lessors of the premises used for the services ("Released Parties") from all claims, liabilities, causes of action, damages, costs or losses arising out of or in connection with our services, whether due to negligence of the Released Parties or otherwise.
(b) That the release under section 9.2(a) also applies in particular when risks or side effects associated with the service occur and damage results, or if you do not follow the instructions of the doctor before, during or after an analysis, treatment, or activity.
(c) To be responsible for your valuables and your personal belongings yourself (as we cannot guarantee that they will be stored safely) and that we and the Released Parties are not liable for loss or damage.
(d) That Ahead is not responsible for services that are not provided by Ahead but by service partners or other third parties ("Third-Party Services"), and that you fully indemnify and hold Ahead harmless in this regard.
(e) To authorize us, our employees, and agents in the event of an injury or medical emergency to obtain medical care, including transportation, hospitalization, or other medical measures that are deemed necessary.
(f) To agree that liability for slight negligence is completely excluded, to the extent legally permissible.
9.3 Service Availability
We strive to ensure that our website and app are available continuously and function correctly, but we cannot guarantee uninterrupted access or error-free operation.
9.4 Medical Services
We are not liable for any actions, inactions, negligence, or malpractice by our medical partners. Any claims relating to medical services should be directed to the medical partner who provided the service.
9.5 Limitation of Damages
To the extent permitted by law, we expressly exclude liability for:
Indirect, incidental, or consequential damages
Loss of profits, revenue, data, or business opportunities
Damages resulting from reliance on information provided on our website or app
Service and business interruptions or failures
Our limitation of liability does not apply to damages caused by gross negligence or willful intent.
9.6 Cap on Liability
In no event shall our total liability exceed the amount you have paid us for the specific service giving rise to the claim.
10. Data Protection
10.1 Data Processing
In our Privacy Policy, we inform you how we process and protect your personal data (including your health data). Please read it carefully and ask us any questions.
10.2 Data Sharing with Partners
If a service is provided by a service partner or other third parties, you agree that (a) Ahead may disclose your data collected in the context of providing the service to such service partners or other third parties if this is necessary for the provision of the service by them, and (b) such service partners or other third parties may disclose your data collected during their service provision to Ahead. For subsequent processing by Ahead, the Ahead Privacy Policy applies.
10.3 Release from Professional Secrecy
If a release from professional secrecy is required for the transmission of your data according to section 10.2, you consent to such release to the extent mentioned in section 10.2.
11. Modifications to Terms and Services
11.1 Changes to Terms
We may modify these Terms and Conditions at any time. We will notify you of material changes through our website or via email. Without your written objection (e.g., email) within one month after we have informed you, the changes are deemed approved. The current valid version of these Terms and Conditions is available on our website.
11.2 Service Modifications
We reserve the right to modify, suspend, or discontinue any part of our services at any time, with or without notice.
12. Termination
12.1 Termination by You
You may terminate your account at any time by contacting us at get@ahead.clinic.
12.2 Termination by Us
We may suspend or terminate your access to our services at any time, without notice, for any reason, including if we believe you have violated these Terms and Conditions.
12.3 Effect of Termination
Upon termination, your right to use our services will immediately cease. Any outstanding payments remain due. All provisions that by their nature should survive termination shall survive, including intellectual property provisions, warranties, and limitations of liability. Termination does not affect your right to access your personal data as provided by applicable law.
13. General Provisions
13.1 Entire Agreement
These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Ahead Health AG regarding your use of our services.
13.2 Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The parties shall replace the invalid or unenforceable provisions with provisions that are valid and enforceable and that best reflect the original intent of the parties and, if possible, lead to the same economic result.
13.3 No Waiver
Our failure to enforce any right or provision of these Terms and Conditions will not be considered a waiver of those rights.
13.4 Assignment
You may not assign or transfer these Terms and Conditions without our prior written consent. We may assign our rights and obligations under these Terms and Conditions without restriction.
13.5 Force Majeure
We shall not be liable for any failure of or delay in performance of our obligations under these Terms and Conditions to the extent such failure or delay is due to circumstances beyond its reasonable control, including, without limitation, acts of God, acts of government, flood, fire, earthquakes, civil unrest, acts of terror, strikes or other labor problems, or Internet service provider failures.
14. Governing Law and Jurisdiction
14.1 Governing Law
These Terms and Conditions are governed by Swiss law, without regard to its conflict of law provisions or international treaties that would lead to the application of other law.
14.2 Jurisdiction
Any disputes arising out of or relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.
